Withdrawal Policy

Who you are and what this policy covers

This withdrawal policy applies to consumers who conclude a distance contract with PUENJER, S.L.U. for the use of the platform "GardenPilot" subject to payment, in particular for the purchase of credits. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

Please also note the information on the early expiry of the right of withdrawal further below: as soon as you redeem credits to have an individualized garden concept or plan created, your right of withdrawal lapses for that part of the service.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

You can also complete and submit the model withdrawal form or any other clear declaration on our website via the dedicated withdrawal button (pursuant to Section 356a BGB – German Civil Code). If you make use of this option, we will send you confirmation of receipt of such a withdrawal without delay (e.g. by email).

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

When purchasing credits, we will refund the unused credit balance from the withdrawn purchase. If you have already redeemed credits to make use of a service subject to payment (e.g. the creation of a garden concept or plan), your right of withdrawal for that used part has lapsed in accordance with the section below; to that extent, there is no entitlement to a refund.

Early expiry of the right of withdrawal (digital content)

For the supply of digital content that is not supplied on a tangible medium, your right of withdrawal lapses if we have begun the performance of the contract after you have

1. expressly consented to us beginning the performance of the contract before the end of the withdrawal period, and
2. confirmed your knowledge that, by giving your consent, you lose your right of withdrawal upon the commencement of the performance of the contract, and
3. we have provided you with a confirmation of the contract (Section 356(6)(2) BGB – German Civil Code).

The garden concepts, visualizations and plans created with GardenPilot are digital content that is produced for you on the basis of your individual information. The early expiry of the right of withdrawal described above pursuant to Section 356(6)(2) BGB (German Civil Code) applies to them.

In practical terms: as long as your credits remain unused, you can withdraw from the purchase within the 14-day period and receive a refund of the unused balance. As soon as you redeem credits to have an individualized concept or plan created – and have expressly consented to the corresponding immediate performance while confirming the loss of the right of withdrawal – there is no longer any right of withdrawal for that part of the service.
